01The agreement
These Terms of Service (“Terms”) are an agreement between you and SketchMind (“SketchMind”, “we”, “us”) about your use of the SketchMind websites and app at sketchmind.app and app.sketchmind.app (the “Service”). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you use SketchMind on behalf of a company or team, you accept them for that organization too, and you confirm you're allowed to.
02The Service
SketchMind is an AI-powered collaborative whiteboard: an infinite canvas for drawing, planning and presenting, with AI features that turn a prompt into a visual explanation you can present, and handwriting into text. We continuously improve the Service, which means features can change, improve, or occasionally be retired — we'd rather switch a feature off than ship something bad.
03Your account
- You need an account to use the Service, created with your email address or via Google, Microsoft or Apple sign-in.
- Keep your login credentials to yourself; you're responsible for what happens under your account.
- Give us accurate information and keep it up to date.
- You must be at least 13 years old (or the higher minimum age of your country).
04Plans, billing & AI limits
SketchMind offers a free plan and paid subscriptions, billed monthly or yearly. Paid plans renew automatically until you cancel; cancel anytime and your plan runs until the end of the paid period. Applicable taxes may be added at checkout.
- AI usage is metered. Each plan includes a monthly amount of AI feature usage. When you reach your plan's limit, AI features pause until the next month or an upgrade. Fair-use ceilings protect the Service from extreme use.
- Price changes. If we change prices, we'll tell you at least 30 days in advance; changes apply from your next billing period.
- Refunds. Billing mistakes are always fixed. Beyond that, fees are non-refundable except where the law says otherwise.
05Your content
Your boards are yours. You keep all rights to the content you create or upload. To run the Service we need your permission to host, store, process, display and transmit that content — for example to sync a board to your collaborators or process your content with an AI feature at your request. You grant us that license for exactly those purposes and nothing more. It ends when you delete your content or account, except for what we must keep by law.
You're responsible for the content you put on your boards — make sure you have the rights to use it.
06AI output
AI features generate content based on what you submit. You may use the output as part of your work, subject to these Terms. But AI can be wrong: outputs may be inaccurate, incomplete or similar to output generated for others. Review AI output before you rely on it — especially for anything important. SketchMind doesn't guarantee the accuracy of AI-generated content.
07Acceptable use
Use SketchMind for thinking, planning and presenting — not for harm. You agree not to:
- Break the law, infringe someone's rights, or upload content you have no right to use.
- Upload malicious code, or probe, overload or disrupt the Service.
- Access other people's accounts or data without permission.
- Resell the Service, scrape it, or build a competing product from it.
- Circumvent AI usage limits or other technical restrictions.
- Use the Service to create or spread illegal, hateful or deliberately misleading content.
We may remove content or suspend accounts that violate these rules — with notice where reasonable.
09Our intellectual property
The Service itself — the software, design, SketchMind name and logo — belongs to SketchMind and its licensors. These Terms give you a personal, limited, non-exclusive right to use the Service; they don't transfer any ownership of it to you.
10Ending the agreement
You can stop using SketchMind and delete your account at any time. We may suspend or end your access if you materially breach these Terms, if we must for legal or security reasons, or if we discontinue the Service — in that last case we'll give you reasonable notice and time to export your work. After termination, sections that by their nature should survive (like ownership, disclaimers and liability) survive.
11Disclaimers
The Service is provided “as is” and “as available”. We work hard to keep SketchMind fast, correct and online, but we can't promise it will always be uninterrupted, error-free or perfectly suited to your purpose. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
12Limitation of liability
To the maximum extent permitted by law, SketchMind is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim — or, if you're on the free plan, USD 50. Nothing in these Terms limits liability that cannot be limited by law.
13Changes
We may update these Terms as the Service evolves. When we do, we update the date at the top of this page; for meaningful changes we'll notify you in the app or by email before they take effect. If you keep using the Service after a change, the updated Terms apply. If you don't agree, stop using the Service and delete your account.
14Governing law
These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai, without regard to conflict-of-law rules. Disputes that we can't resolve together first — please just email us — are subject to the exclusive jurisdiction of the courts of Dubai. If you're a consumer, mandatory consumer protections of your own country still apply where the law says they must.
